By using our website or accessing our media, you acknowledge and agree that you shall not reproduce, duplicate, copy, sell, resell, or exploit any part of our website, products, or services without obtaining our explicit written permission.

Furthermore, you are obligated to maintain the integrity of our website, products, and services at all times, and you shall not alter, tamper with, or modify them in any manner. Your use of our website and channels, as well as the information contained therein, is at your own risk, and we hold no liability for any loss, damage, or costs incurred as a result of your reliance on the information provided on our website.

Media Usage:

All media displayed on this website and social media platforms, including images, videos, audio, and other media forms, are the exclusive property of 6ft8photographer and are protected under Australian and international copyright laws. Users are strictly prohibited from engaging in any activity that interferes with or violates the intellectual property rights associated with our media.

A license is required for the use of any media, including usage on social media. To request a license, please send an email to 6ft8photographer@gmail.com each usage of the media requires a separate written license if applicable.

SmugMug Store Purchases:

A purchase made through our online store offers 2 licenses a private which is exclusively for personal and non-commercial use, and a Commercial licence which also covers editorial usage.

Any Personal/Private license purchases are for a license of use and 6ft8photographer retains all copyrights and moral rights in each piece of media created. The license is exclusively for personal use, non-commercial, and no photo editing/manipulation. Licenses are not transferable, the media may not be passed on, sold, or distributed to third parties without written permission or additional licenses purchased for additional use.

Any Commercial License purchase allows the licensee to use the image for commercial & editorial use. 6ft8photographer retains all rights copyright and moral rights over the image and must be credited correctly (Image Credit: Henry Yates | 6ft8photographer). No image editing/manipulation is permitted. Licenses are not transferable, the media may not be passed on, sold, or distributed to third parties without written permission or additional licenses purchased for additional use.

Note* Any breach of license terms is an unauthorized use and will be charged per image usage at our penalty rate.

Copyright and Intellectual Property:

All content featured on our website, social media platforms, and stores is either owned by us, licensed to us, or exclusively licensed to third parties. Such media is protected under Australian and international laws, and this protection is not limited.

Any breach or unauthorized use of media without the express written approval of Henry Yates (6ft8photographer) may result in legal proceedings. In the event of unauthorized use, the infringing party shall be liable to pay a minimum fee equal to a minimum of $5000 USD per media per use, with the amount potentially exceeding $100,000 USD depending on the extent of the breach.

Return Policy:

Due to the nature of printed images, no returns can be made once the order is processed. Any claims for damage, defects, or other related issue must be made through email within 5 business days once a receipt has been issued.

Any orders that we processed incorrectly will be replaced once the merchandise and original receipt are provided. However, we will not replace products that we deem have been misused or mishandled by the purchaser.

Unauthorized Use:

Any usage of our media on social media, online publication platforms or any other channel including but not limited to websites, publication and its associated marketing channels, has been licensed for use and therefore use without prior written permission or without obtaining the appropriate license shall be considered a violation of our copyright and intellectual property rights and is an unauthorised use.

Please note any use on Open Graph protocol websites without written approval or purchasing a license to use is strictly prohibited, if used without correct licensing is considered a breach.

Further to this point, it is the user’s responsibility to ensure that they have the correct authority to use the ‘media’. Please note that without confirmation from ‘Henry Yates/6ft8photographer’ for the specific media use, it is considered to be a breach. It’s the third party’s responsibility to do the due diligence before using such media given to them or which they find online. The best practice would be to write to find out who took the photo and then request permission. If the infringing party fails to use best practices and does not purchase a license for use, they are liable for the total amount.

Note: A licensee can also provide an event which they are attending an image for the event’s exclusive use to promote ‘Below the Line’. However, the event is not allowed to share this media with any other third parties including but not limited to event sponsors and partners, without written approval from Henry Yates (6ft8photographer).

A licensee does not have the authority to grant a valid license to any third party for the use of media. Unless they have purchased or been granted a license enabling them to do so. The licensee may provide images to third parties for use, however, it is the sole responsibility of the third party to ensure that they have a valid license to use the content before use. The licensee is not liable for a third party's use of images if that third party does not do their due diligence before using the media.

Please note that any breach needs to be resolved correctly, simply removing the content does not constitute a resolution.
